There are two pieces of legislation which affect fencing. If you wish to view the detail of the Acts, click on the links below which will take you to “Statutes of New Zealand”. Once there, click on “F” and select whichever Fencing Act you wish to view:
Boundary Fences:
Procedures regarding building or repair of boundary fences are covered under the Fencing Act 1978. The Act in particular covers the rights, responsibilities and consent of neighbours on both sides of the boundary fence. Construction details (type, height etc.) of the fence itself may be covered by local council by-laws which can vary from area to area.

Pool Fences:
Pool fences are specified and are compulsory under the Fencing of Swimming Pools Act 1987.
